New Delhi: People whose TDS is deducted on their income but do not have any tax liability can get refund in future plane without filing Income Tax Return (ITR). On a public interest litigation (PIL) filed regarding this demand, the Delhi High Magistrate has issued a notice to the Inside Government and sought its response. The petition states that an will-less TDS refund system should be implemented for such taxpayers so that the compulsion to file ITR just to get the refund can be eliminated.
Which rule has been challenged in the High Court?
Section 433 of the Income Tax Act, 2025 has been challenged in the petition. As per the current rules, it is necessary to file income tax return to get TDS refund. The petitioner argues that there is no justification in filing returns just to get refund from people who do not have any income tax liability and who are not mandated to file ITR under the law.
What has the Delhi High Magistrate said?
The seat of Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia has issued a notice to the inside government seeking its response on this matter.
